It's not just about money anymore

You've seen them if you've walked through any urban "flea market:"  "knock-off" Gucci purses, shiny men's wrist watches that sure look like Rolexes, and Nike "Air Jordans" for a fraction of the cost of the real thing.

Although Counterfeiting refers to the act of illegally printing money or currency, and we have handled our share of counterfeit money cases, counterfeiting may also refer to producing fake documents (those under Government Seal for example), clothing and other goods.

The Governmental entity that is charged with investigating this crime is the Secret Service, although the FBI and other Federal agencies routinely assist in these cases. These charges are very serious and carry severe penalties. For example, the Government will almost always seek to hold the accused accountable for the actual, retail costs of the counterfeit goods — not the "knock-off" price.

There are, however, some effective defenses to counterfeiting, including, but not limited to, lack of knowledge.  Remember, the Government has to prove that the accused knew, or should have known, that the goods were indeed counterfeit.
